1. Acceptance of Terms

Welcome to Andiamo! These Terms and Conditions ("Terms") govern your access to and use of the Andiamo mobile application (the "App"), website, and services (collectively, the "Service"). By downloading, accessing, or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use our Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service.

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept all responsibility for activities under your account
• Notify us immediately of any unauthorized access or security breach

3.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms.

4. License and Access

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any proprietary notices or labels
• Use the Service for any commercial purpose without our written consent
• Access the Service through automated means (bots, scrapers, etc.)
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any illegal or unauthorized purpose

5. Subscriptions and Payments

5.1 Free and Premium Features

We offer both free and premium (subscription-based) features. Free features are subject to limitations. Premium features require a paid subscription.

5.2 Subscription Terms

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You will be charged through your App Store or Google Play account
• Subscription prices are subject to change with notice
• You can manage or cancel subscriptions through your App Store or Google Play account settings

5.3 Refund Policy

Refunds are handled in accordance with Apple App Store and Google Play Store policies. Generally, all sales are final. For issues or disputes, please contact our support team at niccolo047@gmail.com.

5.4 Free Trials

We may offer free trials for premium features. If you do not cancel before the trial period ends, you will be automatically charged for a subscription. We reserve the right to limit free trial eligibility.

6. User Content and Conduct

6.1 Your Content

You retain ownership of any content you create, upload, or submit through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the Service.

6.2 Prohibited Content

You agree not to post or share content that:

• Is illegal, harmful, threatening, abusive, or otherwise objectionable
• Infringes on intellectual property or privacy rights
• Contains malware, viruses, or harmful code
• Is spam, advertising, or promotional material
• Impersonates any person or entity
• Contains hate speech or discriminatory content

7. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, and the selection and arrangement thereof) are owned by Andiamo, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

"Andiamo" and our logo are trademarks of Andiamo. You may not use these marks without our prior written permission.

8. Third-Party Services and Content

The Service may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the availability, accuracy, or content of such third-party services. Your interactions with third parties are solely between you and the third party.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• We do not guarantee that the Service will be uninterrupted, secure, or error-free
• We do not guarantee specific results from using the Service
• We do not warrant that defects will be corrected or that the Service is free of viruses
• Language learning results vary by individual effort and circumstances

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANDIAMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Andiamo and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us at niccolo047@gmail.com and attempt to resolve the dispute informally.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Andiamo is registered, without regard to its conflict of law provisions.

12.3 Exception for EEA Residents

If you are a resident of the European Economic Area, you have the right to bring disputes in your local courts, and nothing in these Terms affects your rights as a consumer under mandatory local law.

13. Apple App Store Additional Terms

If you access the Service through an Apple device, the following additional terms apply:

• These Terms are between you and Andiamo only, not with Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with Apple's App Store Terms of Service
• The license granted to you is limited to a non-transferable license to use the App on Apple-branded products

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You must delete the App from all your devices
• All provisions that should survive termination will remain in effect

17. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision will not be considered a waiver of those rights.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published in the Service, constitute the entire agreement between you and Andiamo regarding the Service.
